Partee Racing Composites and Fabrication Warranty

Partee Racing warranties all proprietary parts manufactured by its Partee Racing Composites and Fabrication Division to be free from material defects in design or manufacturing for a period of one (1) year from the date of delivery to the customer (the “Warranty Period”).  Partee Racing shall repair, replace or, in its sole discretion, provide a full cash refund for the purchase price of any such part determined by Partee Racing, it is reasonable discretion, to have a material defect in design or manufacturing during the Warranty Period, provided that such defect has not been caused in any way by the customer’s misuse or abuse of the part.  The customer shall be responsible for the cost of shipping the part to Partee Racing at its shop address in Danville, Virginia, and Partee Racing shall be responsible for the cost of shipping the repaired or replacement back to the customer in the event Partee Racing elects not to provide a full cash refund.  The warranty provided in this paragraph benefits only the original purchaser of the part and is not transferrable.  THIS WARRANTY SHALL BE THE SOLE AND EXCLUSIVE REMEDY FOR A PART WITH A MATERIAL DEFECT IN DESIGN OR MANUFACTURING, AND ALL OTHER WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY EXPRESSLY DISCLAIMED IN THEIR ENTIRETY.

No Other Warranties of Any Type Whatsoever

Other than the Partee Racing Composite and Fabrication part warranty expressly set forth above, Partee Racing offers no warranties of any kind, whatsoever. ALL WARRANTIES ARE HEREBY EXPRESSLY DISCLAIMED IN THEIR ENTIRETY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. That said, we support our work. Ask anyone, and they will tell you we bend over backwards to ensure the customer achieves his, her, or its goals. Moreover, after having been a partner with a major law firm for nearly 33 years, I know that warranties effectively are worthless if the warrantor disagrees that a claim has arisen under the warranty because the warrantee then must commence and prosecute litigation at its expense and incur attorneys’ fees that the warrantee likely will not recover even if it wins, and it may incur the expenses and fees and STILL NOT WIN. It’s a patently bad deal for the warrantee. Much more important is the integrity of the person behind the entity with whom you are doing business, and that’s Peter Partee. So compare that with whatever warranty someone offers you. I’ll put my personal integrity up against any warranty in the business. When potential customers make that comparison, we always get the work, and justly so.
